U.S State Privacy Supplement

This American Leisure Properties U.S. State Privacy Supplement (“U.S. State Privacy Supplement”) is only applicable to residents of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia (“you”). It supplements the information contained in our online Privacy Policy. Unless otherwise defined in this U.S. State Privacy Supplement, any terms defined in the Relevant State Privacy Laws (as defined below) or our Privacy Policy have the same meaning when used in this U.S. State Privacy Supplement.

We have adopted this U.S. State Supplement to comply with the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Delaware Personal Data Privacy Act (“DPDPA”), the Iowa Consumer Data Protection Act (“ICDPA”), the Montana Consumer Data Protection Act (“MCDPA”), the Nebraska Data Privacy Act (“NDPA”), the New Hampshire Privacy Act (“NHPA”), the New Jersey Data Privacy Act (“NJDPA”), the Oregon Consumer Data Privacy Act (“OCDPA”), the Texas Data Privacy and Security Act (“TDPSA”), the Utah Consumer Privacy Act ("UCPA"), and the Virginia Consumer Data Protection Act (“VCDPA”) (collectively the “Relevant State Privacy Laws”). Please take the time to read and understand this U.S. State Privacy Supplement.

Scope

Some Personal Information we collect from you may not be covered by this U.S. State Privacy Supplement. The Relevant State Privacy Laws include certain exemptions that do not apply to our collection and processing of your Personal Information. It is possible that not all Personal Information we collect from or about you is fully covered by the Relevant State Privacy Laws. Accordingly, this U.S. State Privacy Supplement and/or the privacy rights set out herein may not apply to you or to all of your Personal Information. For example, the following Personal Information is not covered by this U.S. State Privacy Supplement:

  • Personal Information we have from residents of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, or Virginia in their capacity as current or former employees, personnel, or independent contractors of American Leisure Properties.

Our Collection, Use, Processing and Disclosure of Personal Information

The Relevant State Privacy Laws require us to give you specific information about the categories of Personal Information we collect about you, the sources from which we have obtained that data, the purposes for which we collect it and the categories of entities to whom we disclose it. Sale of Your Personal Information for Monetary or Other Valuable Consideration

Most of the Relevant State Privacy Laws define the sale of Personal Information as the “exchange of Personal Information for monetary or other valuable consideration by a controller to a third party.” Although we do not sell your Personal Information as the term “sell” is commonly understood to require an exchange for money, we may disclose the following categories of Personal Information:

You may opt-out of certain sales as described in the “How You May Exercise your Opt-Out Rights” section below. Please note that we may provide Personal Information to our processors that perform services for us pursuant to a contract; the right to opt-out does not limit our ability to provide Personal Information to these processors.

Your Privacy Rights

The Relevant State Privacy Laws provide residents with specific rights regarding their Personal Information. This section describes your rights. You may exercise these rights yourself or through your Authorized Agent (as applicable). For more information on how you or how your Authorized Agent can exercise your rights, please see the How to Exercise Your Privacy Rights section below.

As a resident of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, or Virginia, you may have the following rights in relation to your Personal Information:

  • Right to Confirm and Access. You may have the right to confirm whether we process your Personal Information and right to access that Personal Information.
  • Right to Data Portability. To the extent you provide us with your Personal Information and to the extent we process your Personal Information, you may have the right to request that we provide you a copy of, or access to, all or part of such Personal Information in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the Personal Information to another controller without hindrance. We shall not provide data that we believe would disclose our trade secrets.
  • Right to Make a Deletion Request. You may have the right to request that we delete Personal Information that we have collected or received about you. Subject to certain exceptions, we must delete your Personal Information.
  • Right to Correct Inaccurate Personal Information. You may have the right to request that we correct inaccurate Personal Information about you, taking into account the nature of the Personal Information and the purpose of the processing of the Personal Information.
  • Right to Opt-Out of Certain Processing. To the extent provided by the Relevant State Privacy Laws, you may have the right to opt-out of processing your Personal Information for the purposes of: (i) the sale of your Personal Information, and (ii) targeted advertising. We do not engage in profiling in furtherance of solely automated decisions that produce legal or similarly significant effects.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights.

Verifying Your Requests

We may need additional information to authenticate your request. We may need to obtain additional information about you that we do not already have to be able to authenticate your request. If you provide us with new Personal Information that we do not already have about you, we will use it solely for the purpose of authenticating your request. We will let you know via email if we need more information from you to authenticate your request. Please reply to our requests promptly.

We will communicate with you about your requests via email. We will use the email address you provided when submitting your request.

If we cannot authenticate your identity, we will let you know.

Responding To Your Requests

We aim to promptly authenticate and respond to your requests within 45 days of receipt but may require a total of up to 90 days to respond to your requests. If we require additional time beyond the initial 45 days after we receive your request, we will let you know within the first 45 days.

We do not ordinarily charge a fee for our response to your requests. However, we may do so to the extent your request(s) are excessive, repetitive, or manifestly unfounded. If we determine that charging a fee is warranted, as permitted by the Relevant State Privacy Laws, we will let you know and will provide you with an estimate of the associated costs of responding to your request(s).

If we determine that we cannot or will not take the action that you requested, we will let you know. We will inform you of our reasons for not taking action and any rights you may have to appeal the decision. You can submit a request to appeal a prior decision by contacting us at contact@amleisure.com.

We will respond to your requests via email. We will contact you at the email address you provided when submitting your request(s).

How You May Exercise Your Opt-Out Rights

If applicable under Relevant State Privacy Laws, you (or your Authorized Agent) may exercise your right to opt-out of the “sale” (exchange of your Personal Information for monetary or other valuable consideration) and the processing of your Personal Information for targeted advertising by contacting us at contact@amleisure.com.

We will only use Personal Information provided in an opt-out request to review and comply with the request.

Opt-Out Preference Signals

If applicable under Relevant State Privacy Laws, you may exercise your right to opt-out of the “sale” (exchange of your Personal Information for monetary or other valuable consideration) and the processing of your Personal Information for targeted advertising by configuring your web browser to transmit the Global Privacy Control signal. Limitations

The Relevant State Privacy Laws do not apply in full to all Personal Information we collect from or about you. Therefore, even if you are a resident of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, or Virginia and submit an authenticated request, we may not be required to comply with your request.

Information provided in response to a consumer request shall be provided free of charge, up to twice annually per consumer. If requests are manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee as permitted by the Relevant State Privacy Laws.

Changes to Our U.S. State Privacy Supplement

From time to time, American Leisure Properties or its affiliates may update or revise this U.S. State Privacy Supplement. If there are changes to the terms of this U.S. State Privacy Supplement, an updated policy will be posted to the Website and relevant portions of the Services.
